Terms of Service and subscription rules for 260digital.
1. Contractual Relationship & Acceptance
By signing up and subscribing to 260digital ("we", "our", "us"), you agree to comply with and be bound by the following Terms of Service. If you do not agree to these terms, you must not use our services.
2. Description of Service
260digital provides web design and development, online software platforms, and graphic design services under a recurring monthly, quarterly, or annual subscription model. The specific deliverables and inclusions (web design and development, configuration and deployment of online software platforms, graphic design, content maintenance, etc.) are governed by the selected plan details at the time of purchase.
3. Subscription & Billing
All subscription plans are billed in advance on a recurring automatic cycle (monthly, quarterly, or annual). The client authorizes automatic billing using the payment method provided. We reserve the right to suspend or terminate services and portal access if subscription payments are not settled successfully.
4. Intellectual Property & 3-Month Minimum Commitment
Subject to full payment of all outstanding invoices and the completion of a minimum of three (3) months of active subscription, all custom designs, source code, graphics, and other digital assets created specifically for the client will belong exclusively to the client. If the subscription is terminated prior to the completion of the three-month minimum commitment, ownership of the custom code and design files does not transfer, and the client receives no license to use or deploy them independently. Pre-existing 260digital components, commercial third-party fonts, plugins, and server software remain the property of their respective licensors.
5. Subscription Cancellation
Clients may cancel their subscription at any time by notifying us via email. Cancellation will stop automatic renewal for the subsequent billing cycle, keeping services active until the end of the current pre-paid cycle. No prorated refunds are issued for unused days or months within an active cycle.
6. Client Responsibilities
The client is solely responsible for the accuracy and legality of all text, images, trademarks, and other content provided to us for publication. The client guarantees they own the necessary intellectual property rights for such assets and agrees to hold 260digital harmless against any third-party claims.
7. Limitation of Liability
260digital commits to industry-standard quality in design, development, and software platforms. However, since we are not a direct hosting provider (we only configure and link free external hosting services to make the website function), we shall not be liable for any commercial losses, third-party hosting downtime, downtime caused by third-party network or DNS providers, plugin incompatibilities, or unexpected search engine algorithm updates affecting SEO rankings.
8. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Active subscribers will be notified of any significant changes via the registered email address.
